AUTO ACCIDENT… WHAT SHOULD YOU DO?
Better safe than sorry! The best advice I can give when involved in an auto accident is to first dial 911 to report the accident, seek appropriate medical attention and then promptly contact a trustworthy attorney.. the significance of doing each cannot be overemphasized!
The police should be called no matter what! I have seen it too many times where people thought they were being nice by not involving the police only to have the at fault driver later attempt to deny being involved or attempt to deny how the accident occurred. Protect yourself and always call 911 and allow the police to conduct the proper investigation. Doing so will go a long way in streamlining the entire claims process and creating peace of mind.
If you are injured GO SEE A DOCTOR! Too often people involved in auto accidents put off seeking the appropriate medical attention. I have heard every excuse possible including “I thought the pain would go away”, “I didn’t have time” or “I couldn’t get off work”. By not seeking the appropriate medical attention you run the risk of any injury worsening and/or risk a delay in the recovery. Your health should be of paramount concern so GO SEE A DOCTOR! It is always in your best interest to seek prompt medical attention for any injury.
You should also consult with an attorney with whom you trust and certainly an attorney that specializes in this area of the law. And, you should NEVER speak with anyone associated with the insurance company (they will record you) and certainly never sign anything before consulting with an attorney. It is extremely important that an investigation beyond the police investigation be conducted promptly. For example, photographs of the scene and vehicles should be taken and witnesses identified and statements obtained. Further, there are certain time frames within which insurance companies must initiate their investigations and resolve certain claims, including any property damage claim. Insurance companies employ individuals whose only job is to investigate claims. By consulting with an attorney, you not only obtain knowledge and information but level the playing field when it comes to dealing with the insurance companies. Simply put, considering consultations are free, there is really no reason to place your best interest in jeopardy by not consulting with an attorney.
